By accessing the website and/or purchasing products, you affirm that you are at least the age of majority in your jurisdiction and agree to these Terms.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any legal action or proceeding related to this website shall be brought exclusively in a court of competent jurisdiction in the United Kingdom.

2. Products and Services

2.1 Product Descriptions

We strive to ensure all descriptions, images, and pricing of products (fine art prints, digital assets, etc.) are accurate. However, we do not warrant that product descriptions or other content on the website are entirely accurate, complete, reliable, current, or error-free. Print colours may vary slightly from how they appear on your screen due to monitor calibration differences.

2.2 Print-on-Demand Production

Physical prints are made-to-order using trusted third-party production partners. By placing an order, you acknowledge that production times (as detailed in our Shipping Policy) are estimates and may be subject to minor delays.

2.3 Pricing

All prices are listed in Pounds Sterling (£) and are subject to change without notice. We reserve the right to modify or discontinue any product without notice at any time.

3. Intellectual Property and Licensing

3.1 Ownership

All content on this site, including images, text, logos, and the photographs offered for sale, is the exclusive property of James Wolfisz Photography and is protected by UK and international copyright laws.

3.2 Physical Print Purchase

The purchase of a physical fine art print grants you ownership of that physical object only. It does not transfer any right of reproduction, licensing, or commercial use of the image itself. The copyright remains with James Wolfisz Photography.

3.3 Digital Product Licensing (If Applicable)

If you purchase a digital product (e.g., a preset or guide), you are granted a limited, non-exclusive, non-transferable license for personal, non-commercial use only. You may not resell, redistribute, or share the digital files.

4. Ordering and Payments

4.1 Order Acceptance

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason.

4.2 Payment

We accept payment via Shopify Payments. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the site.

5. Limitation of Liability

In no case shall James Wolfisz Photography, our directors, employees, affiliates, agents, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product.

6. Returns and Refunds

Our policy regarding returns, exchanges, and refunds is outlined in our separate Refund Policy document, which is incorporated into these Terms by reference. As prints are custom-made, we generally do not offer returns for change of mind. We refer you to the Refund Policy for details on handling damages or defects.

7. User Conduct

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website following the posting of any changes constitutes acceptance of those changes.
